1. Introduction
1.1 You must be at least 18 years of age to use this website. By using this website you warrant and represent to us that you are at least 18 years of age.
1.2 By using this website, you are agreeing to the Terms & Conditions for Use of this Website (July 2026) and the Privacy & Cookies Policy (October 2024).
1.3 By making this booking, you agree to this Disclaimer: One-to- Lessons Online (July 2026), to the Terms of Service: One-to-One Lessons Online (July 2026) and to provide / have already provided up-to-date information about you as per the Health & Wellbeing Questionnaire : Yoga, Meditation & Mindfulness (July 2026) before the lesson. This agreement applies to all One-to-One Lessons you book with the teacher, and continues to apply unless and until this Disclaimer is updated, at which point you will be asked to agree again.
1.4 If you ask the teacher to arrange a booking directly, rather than through the website's booking system, the terms of this Disclaimer and the Terms of Service continue to apply. Where this is your first booking, the teacher will provide you with a link to both documents, and your booking or attendance confirms your agreement.
1.5 Practices may not be suitable during pregnancy. If you are pregnant, or believe you may be pregnant, please see clauses 4.2 to 4.4 below for what this means for booking or continuing lessons with us.
1.6 You acknowledge that all exercise and activities involve a risk of personal injury, including a small risk of serious injury or death. You agree that you are responsible for your health and well-being in relation to all one-to-one lessons.
1.7 This includes both stillness (seated, standing or supine) and movement, including but not limited to stretching, shaking, intuitive movement, positions and postures, and mindful walking.
1.8 You acknowledge all stillness and movement offered is invitational and that you remain responsible for choosing and adjusting your position, whether still or moving, in a way that is safe and appropriate for you.
1.9 The terms "health & medical conditions", "health & medical matters" and "disability" used in this document refer to your holistic health and wellbeing, including medical, physiological, emotional, psychological and psychiatric conditions and matters.
1.10 You acknowledge that while participation in a lesson may be safe and suitable for you in general, specific instructions and exercises may be unsafe and unsuitable for you. You are responsible for ceasing and/or modifying such instructions or exercises, in accordance with your own needs, health & medical conditions and matters.
1.11 You further acknowledge that yoga, mindfulness, meditation and related practices may increase awareness of thoughts, feelings and bodily sensations, including those that are unfamiliar or uncomfortable.
1.12 You acknowledge that these practices are not intended to cause distress, though they may bring pre-existing thoughts, feelings or sensations into awareness. You remain responsible for pacing your own participation and must inform the teacher at any time if you would like to pause, stop or adapt.
1.13 You acknowledge that the teacher is a professional yoga teacher whose training and experience include meditation and contemplative practices — such as presence, awareness and witnessing — applied both on and off the mat.
1.14 You acknowledge that the teacher is not a yoga therapist, physiotherapist, physical therapist, psychotherapist, counsellor or other professional healthcare provider, and is not qualified to express an opinion that you are fit to safely participate in any lesson or activity. You must obtain specialist advice if you are in any doubt.
1.15 You acknowledge that lessons are not health care, medical treatment or therapy, a substitute for health care, medical treatment or therapy, or intended for working with untreated psychological trauma.
1.16 You acknowledge that the teacher will not always be able to see or hear you fully throughout a lesson, for any reason, and that the same may apply to you not being able to see or hear the teacher. You remain responsible for your own safety and practice at all times, regardless of whether you are being seen or heard.
1.17 You are responsible for ensuring you have a suitable environment for each lesson: a clear, adequately spacious area, free from obstacles or trip hazards, with appropriate flooring or a mat suitable for the practices offered. You must ensure this is in place before each lesson begins, and must adjust your space as needed if the practices offered change.
1.18 You must not participate in any one-to-one lesson while under the influence of alcohol.
1.19 You must not participate while under the influence of any substance, prescribed or otherwise, in a way that impairs your ability to participate safely. The lawful and appropriate use of prescribed or legally available medication is not of itself a reason you cannot participate; you agree that responsibility for assessing your own fitness to participate safely rests with you.
1.20 The teacher retains discretion to pause, decline or end a lesson at any time if she believes you are not able to participate safely, for any reason.

3. No advice
3.1 You acknowledge that the lessons and other services provided by us offer general information and guidance.
3.2 You acknowledge that this information and guidance is not health & medical advice and should not be treated as such.
4. Health & Medical Conditions
4.1 If you are pregnant and participating under an arrangement agreed per clause 4.3, or suffer from any health & medical condition or disability, you should not make any changes to your diet, nutrition, lifestyle, activities or exercise programmes based on the information and guidance offered by us, without first consulting your doctor or another suitably qualified professional health care provider.
4.2 You acknowledge that the teacher is not a pre- or post-natal pregnancy yoga specialist and that practices may not be suitable during pregnancy. You must contact the teacher directly before booking or continuing to participate in any one-to-one lesson if you are pregnant or believe you may be pregnant.
4.3 If you are already working with the teacher and become pregnant, or believe you may be pregnant, you must inform the teacher before your next booking and you must complete a new Health and Wellbeing Questionnaire. The teacher will, in her sole discretion, decide whether to decline to continue teaching you, or to agree a limited period of continued teaching.
4.4 If you disclose that you are, or believe you may be, pregnant during a lesson, or have not already completed the Health & Wellbeing Questionnaire required under clause 4.3, the teacher may pause or end that lesson immediately, at her discretion.
4.5 You warrant and represent that:
(a) to the best of your knowledge, you suffer from no health & medical condition or disability that will or might increase the normal risks associated with the activities provided; or
(b) your doctor or other suitably qualified professional healthcare provider who you deem to be appropriate, has approved your participation in these lessons.
4.6 You must complete a Health & Wellbeing Questionnaire as part of the informed consent process, before your first booking, and again whenever your health changes. You must share any relevant information honestly. If you are asked to provide written confirmation from your doctor that you can safely participate, you must do so.
4.7 You must inform the teacher before or at the beginning of your next lesson if:
(a) you suffer from any new injury, illness or other health & medical condition; or
(b) you are not feeling well.
4.8 The teacher may, in her sole discretion, prohibit you from participating in a lesson, or any part of a lesson, at any time.
4.9 You must comply with all of the teacher's instructions, including the overriding instruction (whether or not stated verbally) to cease any physical exercise or movement within the lesson, and must inform the teacher as soon as possible if:
(a) you feel any physical pain or discomfort during a specific exercise or practice; or
(b) you feel that any physical exercise or movement would be unsafe or physically uncomfortable for you.
4.10 For clarity, this instruction to cease relates to physical safety during exercise or movement. Emotional, psychological or unfamiliar thoughts, feelings or sensations that may arise during yoga, mindfulness or meditation practices are addressed separately at clauses 1.11 and 1.12 above; you are not required to cease practice solely because such experiences arise, though you remain free to pause, stop or adapt at any time.
5. Medical assistance
5.1 You must not rely on the information offered or services provided as an alternative to health & medical advice from your doctor or other suitably qualified professional healthcare provider.
5.2 If you have any specific questions about any health & medical matter, you should consult your doctor or other suitably qualified professional healthcare provider.
5.3 If you think you may be suffering from any health & medical condition, you should seek immediate health & medical attention.
5.4 You must never delay seeking health & medical advice, disregard health & medical advice or discontinue health & medical treatment because of information and guidance offered by us.
5.5 You agree that, in the event the teacher determines that you need urgent health & medical attention, she has the authority and discretion to contact emergency services. Where this is not possible for any reason, including international call restrictions, the teacher will try to reach you directly and/or your emergency contacts, and has the authority and discretion to request that an emergency contact does so on her behalf, in respect of your health and wellbeing. Any costs incurred for such services, however they are contacted, are your sole responsibility.
6. No representations or warranties
6.1 To the maximum extent permitted by applicable law and subject to section 8 below, we exclude all representations, warranties, undertakings and guarantees relating to the services provided.
6.2 Without prejudice to the generality of the foregoing paragraph, we do not represent, warrant, undertake or guarantee:
(a) that you will not suffer from any injury arising directly or indirectly out of the activities provided;
(b) that your fitness, health, wellbeing, or psychological or emotional state will measurably improve as a result of participation in activities provided; or
(c) that lessons will continue to run for any specific period.
7. No Liability
7.1 The limitations and exclusions of liability set out in this section and elsewhere in this disclaimer:
(a) are subject to section 8 below; and
(b) govern all liabilities arising under the disclaimer or in relation to our services, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.
7.2 We will not be liable to you in respect of any personal injury (including without limitation serious injury or death) that you may suffer or sustain directly or indirectly as a result of attending our lessons. Nor will we be liable to you in respect of any other losses arising as a result of any such personal injury.
7.3 We will not be liable to you in respect of any of your personal property that is lost, stolen or damaged before, during or after a lesson.
7.4 We will not be liable to you in respect of any losses arising out of any event or events beyond our reasonable control.
7.5 We will not be liable to you in respect of any business losses, including (without limitation) loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill.
7.6 We will not be liable to you in respect of any special, indirect or consequential loss or damage.
8. Exceptions
8.1 Nothing in this disclaimer shall:
(a) limit or exclude our liability for death or personal injury resulting from negligence;
(b) limit or exclude our liability for fraud or fraudulent misrepresentation;
(c) limit any of our liabilities in any way that is not permitted under applicable law; or
(d) exclude any of our liabilities that may not be excluded under applicable law.
9. Severability
9.1 If a section of this disclaimer is determined by any court or other competent authority to be unlawful and/or unenforceable, the other sections of this disclaimer continue in effect.
9.2 If any unlawful and/or unenforceable section would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the section will continue in effect.
10. Law and jurisdiction
10.1 This disclaimer shall be governed by and construed in accordance with English law, and any disputes relating to this disclaimer or the lessons will be subject to the exclusive jurisdiction of the courts of England and Wales.
10.2 This does not affect any protection you are entitled to under the mandatory consumer protection laws of the country in which you are habitually resident, which continue to apply where relevant, notwithstanding clause 10.1.
11. Details
11.1 In this disclaimer, "we" and "the teacher" means (and "us" and "our" refer to) Holly Elizabeth Étoile, also known as Ella Étoile, trading as Serenity Yoga and providing services under this and the name Yoga with Ella, and to her representatives.
